General Terms and Conditions (GTC)
(Webshop Terms and Conditions – Makari De Suisse Germany)
§ 1 Scope
These Terms and Conditions apply exclusively to all contracts concluded between Makari De Suisse Germany (“Supplier”) and the customer via the webshop makarigermany.de. Conflicting terms shall not apply unless expressly agreed in writing.
A consumer is any natural person acting for purposes outside their trade or profession. An entrepreneur is any natural or legal person acting in the course of business or professional activity.
§ 2 Conclusion of Contract
All product listings in the online shop are non-binding invitations to place an order. A contract is only concluded when the Supplier expressly accepts the order by email confirmation within 2 working days.
§ 3 Products, Availability & Delivery
Product descriptions are based on the webshop information. Images may differ from actual products due to technical reasons. If goods are unavailable, the customer will be informed immediately.
§ 4 Retention of Title
Goods remain the property of the Supplier until full payment has been received.
§ 5 Prices & Shipping
All prices include statutory VAT. Shipping costs are shown during checkout and are borne by the customer unless otherwise stated.
§ 6 Payment
Payment methods include bank transfer, credit card, and cash on delivery. Payment is due immediately upon contract conclusion. In case of delay, statutory default interest applies.
§ 7 Warranty
Statutory warranty rights apply (§§ 434 ff. BGB). Additional guarantees only apply if explicitly stated.
§ 8 Liability
The Supplier is liable only for intent and gross negligence. Liability for injury to life, body, or health remains unaffected.
§ 9 Right of Withdrawal
Consumers have a 14-day withdrawal right. Exceptions apply to hygiene products, opened goods, and customized items as defined by law.
Return costs may apply depending on order value and conditions.
§ 10 Data Protection
Customer data is processed solely for contract execution and not shared without consent, except where legally required.
§ 11 Final Provisions
German law applies. Place of jurisdiction is Mannheim if the customer is a merchant. Should any provision be invalid, the remaining provisions remain valid.
